Terms of Use for Sudokool

Welcome to Sudokool! These Terms of Use ("Terms") govern your access to and use of the Sudokool mobile applications, including Sudokool - Free and Sudokool - Premium (collectively, the "App"). These Terms constitute a binding legal agreement between you and Sudokool ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

1. App Versions

These Terms apply to both versions of the App. The primary differences between the versions are as follows:

Sudokool - Free ("Free Version"): This version is offered at no cost and is supported by third-party advertising. By using the Free Version, you acknowledge that it will display advertisements provided by our partner, Google AdMob. The data practices related to advertising are detailed in the Privacy Policy for Sudokool - Free.

Sudokool - Premium ("Premium Version"): This version is available as a one-time paid purchase from the Apple App Store. It is ad-free. The data practices for this version are detailed in the Privacy Policy for Sudokool - Premium.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the App for your own personal, non-commercial purposes on a device that you own or control, subject to these Terms.

3. Intellectual Property Rights

The App, including its name, logo, design, source code, graphics, and all other content, is the exclusive property of Sudokool and is protected by copyright, trademark, and other intellectual property laws. You may not use, copy, modify, or distribute any part of the App without our prior written consent.

4. Restrictions on Use

Your right to use the App is conditioned on your compliance with these Terms. You agree that you will not:

• Modify, decompile, reverse-engineer, or create derivative works of the App.
• Use the App for any illegal, fraudulent, or malicious purpose.
• Distribute, rent, lease, sell, or otherwise transfer your rights to the App to a third party.
• Remove or alter any copyright, trademark, or other proprietary notices contained within the App.
• Attempt to disrupt the integrity or performance of the App or its related services.

5. Third-Party Advertising (Free Version Only)

The Free Version of the App integrates Google AdMob, a third-party advertising service. You acknowledge and agree to the following:

• The App will display advertisements from third parties.
• We are not responsible for the content of these advertisements or for any third-party websites or services you may access through them.
• Your interactions with advertisers are solely between you and the advertiser. We are not liable for any loss or damage incurred as a result of such dealings. For more information, please review Google's policies.

6. Termination

We reserve the right to suspend or terminate your license to use the App at any time, with or without notice, if you violate any of these Terms. Upon termination, you must cease all use of the App and delete it from your device.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUDOKOOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP, INCLUDING ADVERTISERS; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sudokool operates, without regard to its conflict of law principles.

10. Changes to These Terms

We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms within the App or on our website. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
